Incentive Overlay Zone (IOZ)

The City has established an Incentive Overlay Zone (IOZ) to help achieve the type of development envisioned in our planning and urban design policy for specific prioritised areas.

About

The City is investigating mechanisms to incentivise development and/or streamline the development application processes in spatially targeted areas. The IOZ is one such mechanism.

The IOZ enables additional development bulk and mixed uses – otherwise referred to as ‘intensification’ – to give effect to spatial policy objectives. The City’s Municipal Planning By-Law (MPBL) assigns every property with a zoning, which dictates what is legally allowed on the property. This assigned zoning is commonly known as 'a base zoning'.

An Incentive Overlay Zone creates a special zoning area, over and above the existing base zone(s), which identifies special provisions in addition to those of the base zoning. Property owners and aspiring investors whose properties fall into an IOZ get additional or enhanced development rights, such as:

  • height 
  • floor factor 
  • coverage 
  • setbacks 
  • use rights

Furthermore, the IOZ allows property owners to bypass a land use application process and submit a building plan application if the proposed development complies with the rules prescribed in the IOZ.

The IOZ mechanism is being piloted in selected areas of the following suburbs:

  • Athlone 
  • Bellville 
  • Diep River 
  • Maitland 
  • Parow/Elsies River

How to access the IOZ rights

A detailed manual, the IOZ Operational and Design Guidelines, has been put together to assist in understanding where and how you can develop in the IOZ. The manual includes further information on how the IOZ works, how to check if a property is eligible, the process to follow to apply for the enhanced rights, and how to interpret the rules into the design of the building.

To check if your property falls into one of the proposed IOZ areas, go to City Map Viewer and follow the navigation guide for detailed instructions. Alternatively, you can download an Excel spreadsheet listing all eligible properties.

If your property falls into a proposed IOZ area, check which of the enhanced rules in items 155 and 156 of the revised MPBL are applicable to you.

Refer to the design guidelines and illustrative case studies in the IOZ Manual to accurately interpret the enhanced rules and use rights of the IOZ, and to facilitate a smooth and successful building plan approval process.
